The Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACA) was signed into law on April 24, 2024, and it mandates that social networking services deemed a ‘foreign adversary controlled application’ such as TikTok, be divested from their foreign owners or face a ban. Specifically, the law requires ByteDance, TikTok’s China-based parent company, to sell the app to an approved buyer by January 19, 2025, or face a ban in the United States. The law stipulates a minimum of 270 days for the sale to be completed, but it also allows for a one-time extension of up to 90 days if the President can prove that a deal is progressing with binding legal agreements. However, it appears unlikely President Biden could step in to delay the ban, because ByteDance has stated that it is not for sale. Should the Supreme Court not intervene, the ban would take effect on Sunday, January 19, 2025. If the ban goes into effect, the app may still be used by people who have already downloaded it, even though it won’t be available for new downloads, but it could also degrade service
